Circumstances: They are being concealed by their non-custodial mother, Francina Dacanay Fernandez. A photo and vital statistics are posted below. Her relationship with the childrens' father, John Lee Smith, ended in 2001 and a custody battle over the children commenced. Francina accused Smith of abusing the children, but the allegations were found to be unfounded. In November 2004, she told their father, John Smith, that she planned to take the children to New Zealand for two weeks. He told her this would violate the custody agreement. On the above date, a judge ruled that she could not take them out of the country, but she did so. A felony warrant for kidnapping was issued for her on December 9, 2004, and an FBI warrant for international parental kidnapping was issued for her on February 4, 2005. They are known to have traveled to the Philippines. Their father attempted to arrange a recovery effort for them in the Philippines but Fernandez was tipped off about it and fled. He has since filed a law suit against Fernandez's parents for assisting her in the abduction. They may still be in the Philippines, or may have traveled to Australia or New Zealand.
